These Terms and Conditions govern the use of the Spacedust Films website and the commissioning of services provided by Spacedust Films (“we”, “us”, “our”). By commissioning our services or using our website, you (“the Client”, “you”) agree to be bound by these terms.
Our services and website are available only to individuals aged 18 or over. By using our services, you confirm that you are legally able to enter into a binding contract.
Website content is provided for general information only. You may not use the website for unlawful purposes or in a way that could impair its operation. We reserve the right to modify, suspend, or withdraw any part of the website without notice.
All content created by Spacedust Films — including film/video, photography, drone footage, edits, branding, text, project files and final delivered content — remains the intellectual property of Spacedust Films unless otherwise agreed in writing. Client usage rights are set out in Section 7.
A project is confirmed when the Client provides written acceptance of a quotation or otherwise agrees a project scope in writing. Any deposit, staged payment or advance payment requirements will be set out in that quotation or agreed scope. Invoices are payable within 14 days unless otherwise agreed.
Final delivery timelines are agreed for each commission but may vary depending on project complexity, access, weather conditions, editing requirements and client feedback. Spacedust Films reserves the right to withhold final delivery of content until payment is received in full.
Exterior filming and drone filming can be weather-dependent. Where conditions are unsuitable, unsafe or likely to compromise the quality of the commissioned work, filming may be postponed or rescheduled by mutual agreement.
If access, airspace restrictions, site readiness, safety concerns or other site conditions prevent filming on the agreed date, the shoot may be postponed or rearranged. Where travel, crew, accommodation or other costs have already been committed, we reserve the right to recover those reasonable costs.
If the Client cancels or postpones a confirmed shoot with short notice, we reserve the right to charge for any non-recoverable costs already incurred. We will always aim to keep any such charges proportionate and reasonable.
The Client is responsible for ensuring that filming locations are accessible, safe, legally compliant and suitably prepared. The Client must ensure that all necessary permissions, site access, property consents and releases are in place, including permissions relating to occupants, property owners or individuals appearing on camera.
Spacedust Films retains full copyright ownership of all commissioned content, including film/video, photography, drone footage, editing and final delivered content.
Upon full payment, the Client is granted a non-exclusive, non-transferable, perpetual licence to use the final delivered content for the Client’s own project, property, business and marketing purposes.
Where appropriate to the commissioned project, the Client may provide the final delivered content to the agreed project team, including developers, architects, designers, marketing agencies and PR teams associated with that project, provided the content is used only in connection with that same project.
The content may not be resold, relicensed, sublicensed, submitted to stock libraries, used to promote an unrelated third-party business, or supplied for commercial exploitation by another party without prior written permission from Spacedust Films.
Unless otherwise agreed in writing, this licence applies only to final delivered content and does not include raw footage, project files, unedited clips, working files, unused stills or source materials.
Spacedust Films reserves the right to use commissioned content for its own promotion, including portfolio displays, website, and social media, unless otherwise agreed in writing.
Reshoots required due to client error will be billed separately. Reshoots required due to technical or crew error will be completed at no additional cost.
Spacedust Films is not liable for indirect loss, loss of earnings, or reputational damage. Liability is limited to the total value of the contracted services.
We are not responsible for delays caused by events beyond our control, including weather, illness, equipment failure, travel disruption, or safety concerns.
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If Spacedust Films is commissioned by a private individual acting as a consumer rather than as a business client, statutory cancellation rights may apply under UK consumer law, including in some cases a 14-day cancellation period for distance or off-premises service contracts.
If the consumer expressly requests that work begins within any applicable cancellation period, the consumer may be required to pay for work carried out up to the point of cancellation. The right to cancel may end once the commissioned services have been fully performed. Nothing in these Terms affects any statutory rights that cannot lawfully be excluded.
